Terms, Conditions, & Policies

**Health and Safety**

A negative COVID-19 test, proof of vaccination, OR proof of COVID antibodies (choose one) is required to attend any overnight retreat offered by Cleveland Spiritual. Trip Insurance is strongly encourages to attend any Cleveland Spiritual retreat – we recommend you purchase a comprehensive “Cancel for Any Reason” policy. In the event you are ill and cannot attend your retreat, or for any other reason that you can’t attend, you will need to submit a claim to your trip insurance company for reimbursement (reimbursement subject to the approval/terms of your specific policy). There are no refunds from Cleveland Spiritual Fest, LLC on your final retreat payment. Cleveland Spiritual Fest, LLC is not a trip insurance provider and is not responsible for the specific terms of your policy. Insurance reimbursement for your retreat is not within Cleveland Spiritual’s control and this information does not constitute insurance advice. Please consult an insurance professional and understand your policy coverage limits so there are no surprises for you. As a reminder, upon booking, you agree to our Terms of Service below.


**Corona Virus Terms of Service**

Please note our same Terms of Service apply with the Coronavirus as this is a known entity and there is known risk. Further clarity on our Coronavirus policy is below:

– Please note there are NO REFUNDS for itinerary changes due to the Coronavirus (such as border closures).

-Please note that proof of a negative COVID-19 test is required within 72 hours before your retreat departure and can be submitted via email to clevelandspiritual@gmail.com. If you test positive or fail to provide proof of testing, you will not be allowed to attend the retreat and there are no refunds. Please ensure your trip insurance policy covers COVID-19 (we recommend a cancel for any reason policy).

TERMS OF SERVICE

This page will answer your questions regarding Cleveland Spiritual Retreats (henceforth referred to as “CS”) terms of service. It is your responsibility to fully understand the terms and conditions for each of our retreats set out at www.clevelandspiritual.com (henceforth referred to as “the website”). Should you have questions regarding the terms and conditions of CS, we are available for consultation and would be happy to clarify any areas in advance of signing a contract with us. We cannot provide insurance, medical, or legal advice regarding our terms but can clarify them for you in a way that helps you best understand your investment.

PAYMENT TERMS, CANCELLATIONS + ITINERARY CHANGES

1. Retreat Pricing + Itinerary Changes

All prices are per person and are set well in advance of the retreat start date. Prices vary depending on a variety of cost factors, with peak travel times being the most expensive. We make our best efforts to keep our retreats cost effective so that you can get the most out of your spiritual experience but operate within the confines of our providers and locations costs. You can always find pricing on the website. Prices include retreat costs only; they do not include airfare to and from the retreat and ground transportation (unless noted on the website). Resort gratuities are never included in retreat price. Please consider showing appreciation for our partner organizations if you are highly satisfied with their services. CS believes in fair pricing for all retreat attendees – all prices are set and non-negotiable.

 

While every effort is made to keep to all published itineraries, we reserve the right to make changes for your convenience. In some cases, itineraries may change due to availability of a service or item. In some cases, weather conditions or “acts of god” (e.g. pandemic, hurricane, flood) can necessitate an alteration in the event itinerary, including but not limited to activities or dates of the retreat, does not constitute any reason for refund. No refund for unused services will be considered.

For example, if there are government travel restrictions due to an “act of god” (e.g. weather, pandemic) we will need to change the itinerary/dates to a later time when we can travel without restrictions. We will communicate any changes as early as possible, however, cannot make any guarantees as to no changes.

We do not offer refunds for itinerary changes to new dates. In the event you can’t make the new itinerary dates, we will offer you a 75% credit for use on any Cleveland Spiritual Retreat that is valid for two years. Cleveland Spiritual Retreats reserves the right to correct printing errors or omissions at any time.

 

2. Deposit & Payment Terms

Reserve your spot with a non-refundable $500 deposit per person (regardless of if you are rooming with someone else). See chart below on our Strict Cancellation Policy as to deposit. At least 30 days prior to the retreat date all balances will be due. No refunds, of any kind, will be given within 30 days of the start date of the retreat

 

See terms above regarding changes to itinerary, date changes, and other changes which do not constitute a reason for refund. See blow regarding double occupancy rooms and cancelations.

 

3. Retreat Payment

Payment can be made by credit card via the website. CS will provide an email with the link to make your balance payment. This must be done at least 30 days prior to the retreat. If full payment is not received by 30 days prior to Retreat Start Date, we reserve the right to cancel your reservation and fill your spot. We will make every effort to avoid this situation by contacting you prior to and on the day of the balance due date. No refunds will be issued within 30 days of the start date of the retreat. See blow regarding double occupancy rooms and cancelations.

 

 

4. Strict Cancellation Policy

If you wish to cancel your retreat you must notify CS in writing by contacting celvelandspiritual@gmail.com.  Your cancellation fee will be determined according to the terms outlined in the chart below. Exceptions to our cancellation policy cannot be made for ANY reason, including weather, terrorism, civil unrest, Zika virus, health changes, personal emergencies or otherwise. There is no refund for arriving late or leaving a trip early. Owners reserve the right to make exceptions to this policy in very rare cases, but are not required to consider exceptions or provide any exceptions to the terms.

5. Transfer Policy

Transfers of your registration to a future retreat must be done at least 60 days before the retreat start date. A transfer of the balance minus a $100 processing fee will be made for the future retreat within 2 years of date of cancellation.

 

Registration is not transferable to a different person and must be redeemed by the original purchaser. See blow regarding double occupancy rooms and cancelations.

 

 

6. Retreat Cancellations

CS reserves the right to make any changes deemed necessary; including, but not limited to: CS staffing assignments, advertised excursions, arranged transportation, advertised meals, etc. In the rare case of a CS Retreat complete cancellation, CS will offer a transfer to another CS retreat or a full refund of your payment to CS. CS is not responsible for any expenses or damages incurred as a result of retreat cancellation including preparation costs, airline tickets, travel documents or other expenses. CS reserves the right to cancel any retreat prior to date of retreat for any reason, including in the event that there are too few people booked, in which case you will be given a full refund of any and all payments made to CS. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damages (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes). CS will make every effort to reschedule retreats to avoid cancellation, however, will provide as much advanced notice of cancellation in the rare occasion that it becomes necessary.

 

TRIP INSURANCE & DOCUMENTS

7. Trip Insurance
Guests are highly encouraged to purchase individual trip insurance for international retreats. You can explore  several companies who offer trip insurance, including our CS retreats is not responsible, as stated above, for any issues pertaining to your trip such as illness, pandemic, weather, or otherwise. CS is not a trip insurance company and cannot provide insurance advice. Our retreats are non-refundable and non-transferable according to our terms above. Please be mindful that if you are unable to travel for the retreat you will not receive a refund. We have partnered with Insure My Trip and encourage you to explore trip insurance.

 

Residents from outside the U.S. must check within your country for insurance coverage. We HIGHLY recommend purchasing a cancel for any reason trip insurance as it is the most comprehensive coverage you can purchase. Please note Cleveland Spiritual Retreats is NOT responsible for denied claims or insufficient coverage as we are NOT a trip insurance agency. Cancel for Any Reason coverage is the only policy with the widest “net” to protect your investment.

Cleveland Spiritual Retreats will not be held responsible for any delay, additional expense or inconvenience that may be caused directly or indirectly by events outside of our control (ie: late arrival/departure of flights, civil disturbance, fire, flood, cyclones, severe weather, acts of God, and acts of government, machinery or equipment failure, or cancellations for any reason.) No refunds will be given for “no shows” or days not used resulting from the above aforementioned. Please visit Insure My Trip for more details on trip insurance. 

 

8. Travel Documents and Immunizations
It is the responsibility of each traveler to obtain all required travel documents including Visas unless otherwise noted. Information regarding necessary documentation is provided as necessary on our website or you can contact us for more detailed information. It is your responsibility to purchase correct immunizations. Please contact your nearest travel clinic for the latest requirements.

 

ACKNOWLEDGEMENT

9. Assumption of Risk
I acknowledge that I have voluntarily enrolled to participate in CS retreats. In consideration of CS allowing me to participate in CS retreats, I agree to this release of claims, waiver of liability and assumption of risks. On behalf of myself, my heirs, executors, successors, administrators and any other person who may have an interest at common law or by operation of statute, I hereby waive any and all claims I or such parties may have now or in the future. I release from liability CS and any employees, guides, agents or representatives (“the releasees”) for any personal injury, death, property damage or loss or any nature suffered by me as a result of participation in any activity on the retreat. I release from liability CS for any cause whatsoever including those arising out of, or in any way connected to or occasioned by the negligence of the releasees.

 

The terrain, natural areas and ocean are subject to natural forces which result in obstacles and hazards. In some instances, activities that contain water can be cold and/or turbulent and extended immersion can be life threatening. Risks can include but are not limited to:

  1. Isolation: CS retreats may be in wilderness and natural areas which may not be regularly patrolled, communication may be difficult and rescue and medical treatment may not be available for hours.

  2. ii) Animals: CS retreats may include hiking in natural areas which may result in encounters with wild animals and insects which may injure or kill.

  3. Weather: conditions vary from retreat to retreat and may include but rapid and/or extreme changes presenting significant challenges.

  4. Environmental Risks and Hazards: varying from retreat to retreat and may include but are not limited to: rapidly moving, deep or cold water; insects, snakes and predators, including large animals; falling and rolling rock; lightning, flash floods and unpredictable forces of nature, including weather which may change to extreme conditions without warning. Possible injuries and illnesses include hypothermia, frostbite, high altitude illnesses, sunburn, heatstroke, dehydration and other mild or serious conditions.

  5. Activities: varying from retreat to retreat and may include but are not limited to: hiking, backpacking and climbing in a wide variety of environments including on rock, snow and ice; bicycling on trails and roads with a wide range of surface conditions and traffic volume; rock climbing, climbing on climbing apparatus and ropes courses, using zip-wires and rope swings; white-water rafting, river kayaking, paddle boarding, sea-kayaking and canoeing; swimming, snorkeling and surfing; fishing.

  6. Spiritual experiences: varying by each participant, retreat attendees may experience a spiritual experience that includes but is not limited to physical manifestations of this experience.

Throughout the retreat, participants are responsible for their own safety. Aside from a basic first aid kit CS is not authorized to and will not maintain medical staff or treatment on site.

I acknowledge the enjoyment and challenge I receive from the activities of this CS retreat and the wilderness and natural outdoor experience, its isolation and the opportunity to experience wildlife and nature in a natural surrounding and state, and emotional experiences resulting from personal growth exploration, this is my reason for participating in CS retreats, and I voluntarily assume all risks associated with these activities and freely waive any and all legal rights that I may have against the releasees.

PHYSICAL TRAINING RELEASE OF LIABILITY

10. Express Assumption of Risk

I, the undersigned, am aware that there are significant risks involved in physical training, including but not limited to, the physical training inherent to all yoga exercise activities and spiritual training, and that my participation in any such physical training program carries with it the potential for death, injury, and/or property damage. The risks include, but are not limited to, falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains; those risks caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and trainers and lack of hydration. These risks are not only inherent to physical training and athletics, but are also present for volunteers and spectators. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching in any physical training, including this yoga program.

I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others.

 

I acknowledge that I am willingly participating in these activities and that I have assumed all risks as described above. In consideration for my being allowed to participate in the activities offered, I, the undersigned hereby release CS, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid,

 

I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with the hosting organization to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.

 

Indemnification: The participant recognizes that there is risk involved in the types of activities offered. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Yoga Activist and the hosting organization, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training.

ALLERGEN ENVIRONMENT

11. Food Allergies and Allergies Notification, Acknowledgement, and Release of Liability

While CS retreats will make every attempt necessary to ensure participants allergies and food preferences are reasonably accommodated for, an environment free of allergens, including but not limited to food allergens, CANNOT be guaranteed on a CS retreat. Therefore, the released parties cannot guarantee that any particular food product is free of all traces of any particular allergen, that consumption of a food product will not result in some form of allergic reaction, or that the participant will not come into contact with any allergens while in attendance on CS retreats. The undersigned acknowledges and agrees that they are aware of such risks and that participation in the event will expose the participant to food, activities and persons that may result in exposure to allergens and injury and, in that regard and assuming such risks, the undersigned hereby fully releases and discharges the Released Parties (CS and its partners) from any and all liability and/or responsibility to the participant, the undersigned, or any third party for death and/or injuries to the participant, and/or any direct, indirect, punitive, incidental, or any damages that arise out of or relate to participant’s participation in CS retreats and/or exposure to food allergens. Aside from a basic first aid kit CS, is not authorized to and will not maintain medical staff or treatment on site. See statements above regarding risks.

MEDIA

12. Permission for Capture and Use

Media is defined as photography, video, written or verbal testimonial, or any other form of capturing likeness. For valuable consideration received, I grant to CS the absolute and irrevocable right and unrestricted permission concerning any captured media that she/he has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish in whole or in part, individually or in connection with other material, in any and all publishing platforms now or hereafter known, including the Internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if she/he so chooses. I release and discharge CS from any and all claims and demands that may arise out of or in connection with the use of the media, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, Videographer, Interviewer, Editor, as well as the person(s) for whom he/she captured the media. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.

WAIVER

13. Release and Waiver of Liability


As consideration for being permitted by CS to participate in these activities, I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make a claim against, sue or attach the property of CS, their affiliates, employees, agents or volunteers or any of their affiliated organizations for injury or damage resulting from acts, howsoever caused, by any employee, agent, or contractor, or any of their affiliated organizations, as a result of my participation in CS retreats. I hereby release CS, and any of their agents or affiliated organizations from all actions, claims or demands that I, my assigns, heirs, distributees, guardians, and legal representatives now have or may hereafter have for injury, damage, or death resulting from my participation in CS retreats.

 

I am medically, physically, emotionally and in all respects fit and able to participate in CS retreats.

I agree I will be fully and financially responsible for my own physical condition and well-being during the retreat and will follow the safety precautions and instructions prescribed by CS.

I acknowledge that CS may make suggestions from time to time that are intended to help me and my well-being. However, I take ultimate responsibility for my choices and realize that CS is not licensed medical provider and that I must consult my doctor.

 

I acknowledge that any information provided is for my benefit, but is solely information. No legal, tax, investing, insurance, or medical advice is being provided by anyone at CS and I understand that my interpretation of the information is my responsibility and any action taken based on my interpretation is my responsibility.

 

I understand that all information and opinions expressed are those of CS and its owners and employees and no coercion or influence is being impressed upon me to believe the information, act upon the information, or change myself in some way.

 

If I experience pain or discomfort during the retreat, I will modify CS’s instruction to suit my individual needs. I will not hold CS responsible for any pain or discomfort I experience during or after the retreat. I understand that the activities offered on this retreat are not a substitute for legal or medical care. I understand that CS is not qualified to perform spinal or skeletal adjustments, diagnose, prescribe, or treat physical or mental illness.

 

For the benefit of everyone on your CS retreat, CS reserves the right to accept or reject any participant at any time without liability, and in the event it determines, in its sole and exclusive discretion, that a participant is disruptive to the harmony of the retreat, it may without any obligation to pay a refund or any other amount whatsoever, expel such participant from the retreat and ban participant from future retreats. CS will carry no responsibility or liability for any participant who leaves the retreat prior to its conclusion or for any activity undertaken by any participant which is not included on the retreat itinerary.

 

 

CODE OF CONDUCT

 

14. Participant Code of Conduct.

 

All CS retreat attendees agree to the following code of conduct which is in place for the safety of all participants and staff. We hope to foster an environment where everyone behaves respectfully and appropriately at all times. Adherence to the rules allows us to provide an exciting, rejuvenating, and safe retreat for everyone. Violations of these policies or codes, as listed below, can result in immediate dismissal without refund at CS retreat facilitator’s discretion.

  • Endangering the health and/or welfare of yourself, other participants or staff in any way whatsoever.

  • Offensive, prejudice, sexist, or any other abusive language is unacceptable.

  • Any act of physical aggression against a fellow participant or member of CS staff.

  • Judgement, gossiping, or negative talk towards other retreat participants.

  • In regard to interpersonal relationships, we expect campers to refrain from public displays of affection and inappropriate sexual behavior.

  • We expect as adults, each CS retreat participants understands how alcohol and marijuana influence them and CS will hold each participant to a standard of sobriety which allows for their spiritual growth. If any participant appears intoxicated and unable to control their faculties they may be ask to refrain from activities or be expelled from the retreat. Any physical harm to self or others, or damage to any facility or partner location that occurs due to the intoxication of a CS retreat participant will be the sole liability of that participant. CS Retreat Participant may be asked to reimburse damaged individual for the costs of repairing or replacing all the destroyed property. CS retreats will not be the intermediary of this discussion. All injury parties should contact each retreat participant directly.

  • Participants understand that they may not physically or verbally hurt others, and they will respect the feelings safety and personal integrity of themselves and others.

  • Thievery of any kind is prohibited and will be punishable up to and including being expelled from the retreat and banned at future retreats.

  • Participants are all adults and are expected to act as appropriate in a retreat environment. Please remember we are all here to learn and expand our spirituality, so please respect others and act accordingly.

MATERIALS AND COPYRIGHT

15. COPYRIGHT AND USE OF CS MATERIALS

Participant will be provided documentation and materials at and before, or after the retreat. All items are protected by copyright and governed by the United States Copyright Laws. Participant agrees they will not copy, reproduce, appropriate or misappropriate the materials in any way. The materials are the sole possession of CS Retreats and any violation of the copyright may result in prosecution of the violator.

COVID-19 WAIVER

15. COVID-19 Participant Waiver.

 

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. 

Cleveland Spiritual Retreats cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing Cleveland Spiritual Retreats’ services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize Cleveland Spiritual Retreats’ services and/or enter onto Cleveland Spiritual Retreats’ premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

By agreeing to the terms outlined here and elsewhere on the CS website I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation on a CS retreat.

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws rules.
